NOTICE IS HEREBY GIVEN THAT THE COUNTY BOARD OF ARLINGTON CO., VA, on June 14, 2014, in Room 307, 2100 Clarendon Blvd. at 9:00 A.M. or as soon thereafter as matters may be heard, will consider the following cases, after offering the public an opportunity to be heard in a public hearing:

ZOA-14-02  Zoning Ordinance amendment to amend, reenact and recodify the Arlington County Zoning Ordinance, Articles 2, 3, 5, 6, 7, 9, 10, 12, 13, 14, 15, 16, 17 and 18, to: Define lot coverage to include patios 8” or higher than existing or finished grade, decks, stoops and landings 4’ or higher than existing or finished grade, driveways, parking pads and areas used for maneuvering vehicles including any unpaved portions, gazebos, pergolas and in-ground swimming pools and to exclude air conditioners, stormwater planters and other similar equipment, above-ground swimming pools, sidewalks, walkways and temporary structures;  include oriel windows in main building footprint; define areaway, balcony, breezeway, deck, dormer, existing and finished grade, landing, patio, porch, stairs, step, stoop, stormwater planter, trellis and window well; amend building height definition such that when a dormer is >50% of the width of the roof, the midpoint of the roof is measured at the midpoint of the dormer roof; amend half-story definition to codify width (<50% of the width of the roof) and placement (setback >= 6” from the knee/main wall and with knee wall height <= 2’) of dormers that count as a half-story; require eaves of accessory buildings in R districts to be no closer than 1’ to the lot line; allow encroachments into required yards of up to: 18” for bay and oriel windows, 4’ but no closer than 5’ to any lot line for patios 8” or higher than existing [or finished] grade and decks, 4’ into any front yard, rear yard of interior lots and side yard facing a street ROW on corner lots, but no closer than 21 feet to any street ROW for porches, 5’ from any lot line for stairs, and in any required yard for stairs <8” from existing [or finished] grade and trellises; allow other similar equipment and stormwater planters to encroach as allowed for air conditioners with no screening requirement for stormwater planters; define zoning and real property maps as part of the Zoning Ordinance and as source of official zoning district boundaries; allow bike share stations to violate setback and yard requirements; require written approval of compliance from the Federal Aviation Agency (FAA) for all buildings meeting FAA criteria requiring notice; allow by-right, religious institutions in RA7-16, RA-H and MU-VS districts and home occupations in all C districts; allow home day care by use permit for 5-9 children and by-right for up to 5 children in C-O Crystal City, C-TH and R-C districts; authorize the Zoning Administrator to refund all or part of fees paid as follows: 50% of site plan, site plan amendment, use permit, administratively reviewed Form Based Code development, Board of Zoning Appeals use permit, and variance fees; 75% of administrative change and all other permit fees; and 100% of fees accepted in error; reorganize nonconforming use provisions and amend such provisions to be consistent with VA Code requirements: remove amortization requirements for nonconforming buildings and uses related to use, removal in R districts, vacancy, and signs; define force majeure; allow 2 years after damage due to force majeure for nonconforming buildings and structures to be replaced/repaired in a way that reduces or eliminates the  nonconformity to the extent possible, without a variance or use permit, and an additional 2 years in federal disaster areas; correct references and other minor errors that do not change policy; and make grammatical changes for consistency and clarity.

SUBJECT: Consideration of an ordinance to to amend, reenact, and recodify Chapter 10 (Garbage, Refuse and Weeds) of the Code of Arlington County, Virginia, to amend Article I (Refuse) and IV (Recycling) relating to refuse and recycling effective July 1, 2014 to to clarify language in specific articles of the code and add new recycling requirements for the County’s curbside collection program. The proposed ordinance would modify residential set-out requirements for yard waste, eliminate charges for curbside collection of flat-panel TVs and computer monitors, reduce length of time to correct items improperly prepared or improperly set out for collection from seven (7) days to forty-eight (48) hours and create a charge for failing to remove collection carts and containers from the collection point within forty-eight (48) hours of collection.

Regulating Plans, to change the designation of commercial buildings located at 2338-2344 and 2408 Columbia Pike from “Historic Structures” to “Historic Facades,” to require partial preservation of those buildings instead of full preservation as currently designated; and to adjust the Revitalization District Boundary to follow the C-2 zoning district line between S. Barton St. and S. Wayne St., which will add RPC#32-001-056 to the Revitalization District

ADOPTION OF ROSSLYN PLAN FRAMEWORK: The proposed Rosslyn Plan Framework is a framework for future development of the Rosslyn Sector Plan Update. The document proposed for adoption includes a vision statement, vision principles and policy directives addressing transportation, public parks and open space, urban design, land use and sustainability, and building form and height. The policy directives include recommendations such as: extending 18th St. as a new public way through central Rosslyn; widening sidewalks and providing new bicycle lanes and facilities; enhancing Metrorail, bus, and potentially other transit service; removing the Fort Myer Drive tunnel; improving and creating new park spaces; connecting to the Potomac River; focusing future retail along defined corridors; and updating the building heights policy to maintain high priority view corridors and achieve sensitive transitions between high and low density areas, among other goals. The recommendations in this framework generally pertain to the Rosslyn Coordinated Redevelopment District. Based on public comment received during the advertising and public hearing period, further revisions to the document may be made. SUBJECT: Consider adoption of amendments to Chapters 11 and 66 of the Code of Arlington County, Virginia, related to expanding the types of eligible businesses in Technology  Zones by providing a comprehensive yet restricted definition in lieu of naming specific activities;  standardizing tiers of eligibility standards and BPOL rates in all Technology Zones; add a new incentive for expanding technology businesses; reduce the number of employees necessary to qualify as a new technology business and establishing uniform BPOL rates in all Technology Zones.

SUBJECT: Consider adoption of an ordinance to amend, reenact, recodify Chapter 14.2-58.4 of the Arlington County code to include accident report fee changes, effective July 1, 2014. The Police Department proposes that record fees be increased for accident reports (currently $3 per request), criminal history checks, and police report verifications (currently $5 per request each) to $10 for all three types of requests. The increase is requested in order to fully recoup the staff costs associated with providing the service while remaining consistent with fees charged by neighboring jurisdictions.

NOTICE OF PROPOSED REAL PROPERTY TAX INCREASE

The County of Arlington, Virginia, proposes to increase property tax levies.

  1. Assessment Increase:  Total assessed value of real property, excluding additional assessments due to new construction or improvements to property, exceeds last year’s total assessed value of real property by 4.69 percent.
  2. Lowered Rate Necessary to Offset Increased Assessment:  The tax rate which would levy the same amount of real estate tax as last year, when multiplied by the new total assessed value of real estate with the exclusions mentioned above, would be $0.949 per $100 of assessed value.  This rate will be known as the “decreased tax rate.”
  3. Effective Rate Increase: The County of Arlington, Virginia proposes to adopt a tax rate of $.993 per $100 of assessed value.  The difference between the decreased tax rate and the proposed rate would be $.044 per $100, or 4.6percent.  This difference will be known as the “effective tax rate increase.” Individual property taxes may, however, increase at a percentage greater than or less than the above percentage.
  4. Proposed Total Budget Increase:  Based on proposed real property tax rate and changes in other revenues, the total budget of Arlington County will exceed last year’s revised budget by 2.6 percent.
  5. The County also proposes to maintain the real estate tax for properties used for or zoned to permit commercial and industrial uses at the current rate of $0.125 per $100. Revenue from this tax is dedicated for transportation initiatives.
  6. The County also proposes to maintain the sanitary district tax at the current rate of $0.013 per $100 of assessed value. Revenue from this tax is dedicated for the stormwater management fund.
